How to buy a property in Spain safely and with confidence.

Buying a property in Spain differs in several important ways from purchasing real estate in Germany, Austria, Switzerland, the United Kingdom or France. Understanding the process and preparing properly can help avoid many common mistakes.

Finding the Right Property

The first step is finding a property that matches both your personal requirements and your budget.

In addition to location, size and features, it is also important to consider running costs, the condition of the property, potential renovation work, rental opportunities and future resale prospects.

Reviewing the Documentation

Before making a purchase decision, all available documentation should be carefully reviewed.

This includes, among other things:

  • Nota Simple
  • Cadastral documentation
  • Energy Performance Certificate
  • Community fees
  • Existing charges or mortgages
  • Urban planning status of the property
  • Any specific planning restrictions or considerations

A thorough review provides transparency and helps avoid unpleasant surprises later on.

NIE Number and Bank Account

Foreign buyers require a Spanish NIE number (Número de Identificación de Extranjero).

A Spanish bank account can be useful, but in most cases it is not essential. Ongoing payments related to the property, such as electricity, water, community fees or local taxes, can generally be collected from any bank account within the SEPA area that has an IBAN.

Calculating Purchase Costs Correctly

In addition to the purchase price, buyers should take several additional costs into account.

These may include:

  • Property Transfer Tax (ITP)
  • VAT on new-build properties
  • Stamp Duty (AJD)
  • Notary fees
  • Land Registry fees
  • Administrative management fees (Gestoría)
  • Financing and translation costs, where applicable

A realistic calculation of all acquisition costs should be carried out before making a final decision.

Reservation and Private Purchase Contract

Once the buyer and seller have reached an agreement, a reservation agreement or a private purchase contract is usually signed.

Upon signing the private purchase contract, a deposit of approximately 10% of the purchase price is normally paid.

At Villas Azahar, we do more than simply advise our clients during this stage. We prepare the private purchase contract ourselves and draft it in the respective languages of both buyer and seller. This ensures that all parties fully understand the agreed terms, as well as their rights and obligations.

Completion Before the Notary

The official transfer of ownership in Spain takes place before a notary.

At this appointment, the purchase price is paid, the public deed of sale is signed and ownership of the property is officially transferred to the buyer.

If desired, we personally accompany our clients to the notary appointment and assist with any language, administrative or organizational matters.

After the Purchase

Even after completion of the notary, several formalities still need to be dealt with.

These may include:

  • Changing utility contracts for water and electricity
  • Arranging insurance policies
  • Tax and administrative registrations
  • Organizing renovation or improvement works
  • Holiday property management
  • Rental and property administration
